Removing a SIS alert after an IRTF

A SIS alert linked to an IRTF is not merely an IT entry. The underlying decision must be identified, its current legal status checked, and the right route selected: challenging the IRTF, seeking its repeal, or exercising access and rectification rights over SIS data.

The IRTF and the SIS alert are different

An IRTF is a legal decision made by the French authorities. The SIS is the system in which the alert is recorded so that participating states can act on it. Removing data without addressing the decision on which it rests is therefore not always possible.

Notice of an IRTF must inform the person that an alert will be entered for refusal of entry and stay. Keep the full order, proof of service and any record provided during a border check or visa application.

Review the IRTF’s duration and starting point, any judgment or repeal, and which state entered the alert. A civil-status error or mistaken identity requires a different response from an alert based on an IRTF that is still legally effective.

Keep any court judgment, repeal decision or evidence of expiry. The corresponding update of SIS data should then be checked rather than assumed.

Choose the appropriate procedure

A newly served IRTF is challenged under the procedure and deadline notified with the OQTF. If it has become final, a request for repeal may be considered in light of the legal conditions and current circumstances.

Rights of access, correction and erasure relate to SIS data. They do not replace proceedings against the IRTF itself. A data request should identify the person, the disputed alert and the supporting documents precisely.

Documents to assemble

Prepare copies of the passport and civil-status records, the complete order, proof of service, any judgment and evidence of the present situation. For mistaken identity, add documents that distinguish the person from the individual concerned by the alert.

If a consulate, border police unit or other authority mentioned SIS, record the date, place and exact information given.

How counsel follows the case

Counsel determines whether to challenge the IRTF, seek repeal, exercise data rights or combine those routes. She can pursue the competent authority and monitor the practical effect of a successful judgment.

The absence of an alert should not be inferred from silence. Documentary confirmation helps avoid discovering the problem only at a border or during a visa application.

Frequently asked questions

Does cancellation of the IRTF remove the SIS alert?

It removes the legal basis for an alert linked to that IRTF, but the database update should still be checked. Keep the judgment and seek follow-up if the alert appears to remain.

Can I request erasure of the data alone?

Data rights may be used where information is inaccurate or unlawfully retained, but a data request does not replace challenging an IRTF that remains valid.

What should I do before travelling?

Do not rely only on the passage of time. Check the IRTF’s duration, its starting point and the status of the alert before travelling.
