What to do first
Keep the complete order, the envelope, any delivery notice and evidence of the date and time of service. If the originals cannot be sent immediately, take a clear photograph of every page.
Find the section setting out appeal rights and time limits. For decisions governed by Article R. 911-1 of the French Administrative Justice Code, the court application must be filed within one month. Detention, house arrest or another special procedure may change the route, so the notice must be checked at once.
Read each measure on its own terms
The OQTF states why the prefecture considers that the person must leave France. An IRTF additionally prohibits return and leads to an alert in the Schengen Information System. The country-of-removal decision identifies the proposed destination. The appeal should address the specific reasoning for each measure.
Where no voluntary-departure period is granted, French law generally provides for an IRTF unless humanitarian circumstances justify otherwise. Its duration and reasoning can still be examined against the statutory criteria and the person’s circumstances.
Build an evidence-based appeal
The grounds of the order should be tested against verifiable facts: length and circumstances of residence, family life, health, studies or work, pending immigration steps, risks in the designated country and any earlier administrative decisions.
Documents should be legible, dated and arranged as a chronology. A coherent set of records is normally more useful than a single general statement. Foreign-language documents may need to be translated.
What the application may seek
Depending on the file, the application may challenge the OQTF, the refusal of voluntary departure, the designated country, the IRTF and an associated residence refusal. It may also seek directions needed to give effect to the judgment, such as reconsideration of the case.
An informal or hierarchical administrative request does not extend the court deadline under Article R. 911-1. It should not be used as a substitute for a timely court application.
How counsel assists
Counsel checks the procedure and the decision-maker’s authority, tests the stated reasons against the record, selects the relevant grounds and frames the relief sought. She also organises any later evidence and prepares for a hearing where one is listed.
No outcome can be guaranteed. The assessment depends on the applicable rule, the date of service and the evidence specific to the individual case.

You can send the firm the essential facts, relevant dates and any known deadline.
Frequently asked questions
What should I send first?
Send the complete order, including every page, and evidence showing when and how it was served. Those documents are needed to identify both the deadline and the measures that can be challenged.
Is writing to the prefecture enough?
Not where Article R. 911-1 applies: an administrative request does not stop the court deadline. The correct procedure should be checked immediately.
Which personal documents matter most?
Prioritise records that answer the order’s stated reasons: identity and family documents, address and presence in France, work or study records, medical evidence, pending applications and, where relevant, evidence of risk in the country of removal.
