An individual alternative to detention
The judicial judge may order house arrest where the person offers effective guarantees that they will remain available. A genuine, stable and verifiable address is important, but it may not be sufficient on its own.
Identity, travel documents, personal ties, earlier measures and compliance with previous obligations may also be considered. A prior failure to comply with house arrest makes the assessment more demanding.
Passport and supporting documents
For judicial house arrest under Article L. 743-13 CESEDA, the law generally requires the original passport and other identity documents to have been handed to the police or gendarmerie in advance, against a receipt.
The file should also contain a detailed accommodation statement, the host’s identity document, recent proof of address and, where relevant, family, medical or employment records showing that the proposed arrangement is genuine and workable.
Understand the obligations
House arrest requires the person to remain within the prescribed area and comply with reporting or attendance requirements. The order must be read carefully: place, frequency, hours and duration should never be assumed.
Non-compliance can have serious consequences, including for later coercive measures. Before proposing an address, check that the required journeys and reporting times are practically possible.
Prepare before the hearing
Documents should be sent early enough to be checked. The host should understand that they may need to confirm the accommodation arrangements and provide clear supporting records.
Submissions should explain in practical terms why the person will remain contactable and attend as required. Any earlier difficulty should be addressed honestly, together with new facts reducing the risk of non-attendance.
Counsel’s role
Counsel checks whether the legal conditions are met, verifies the supporting papers and presents a realistic proposal to the judge. She separately addresses any defects in, and the continuing necessity of, detention.
House arrest does not determine the challenge to the removal measure. Each procedure must be followed separately and within its own time limit.

You can send the firm the essential facts, relevant dates and any known deadline.
Frequently asked questions
Is an accommodation letter enough?
No. It should be supported by the host’s identity and address evidence and form part of a wider set of effective guarantees.
Must the original passport be handed over?
For judicial house arrest under Article L. 743-13, advance surrender of the original identity documents to police or gendarmerie is generally required, against a receipt.
Does house arrest cancel the OQTF?
No. It may replace detention as a means of supervision; any challenge to the OQTF remains separate.
