Appealing a child protection order in France

An appeal asks the juvenile chamber of the French court of appeal to review a child protection order. The time limit is short, so the order, its notification and the provisions being challenged must be identified immediately.

Who may appeal and within what time

Either parent, the guardian and the person or service caring for the child may appeal within fifteen days after notification. The child may appeal within fifteen days after notification or, if the order was not notified, after becoming aware of it. The public prosecutor also has a right of appeal.

Keep the full order and the notification envelope. Record the precise date of receipt, check to whom it was addressed and read the remedy information. A request for an explanation or an appointment should not be assumed to extend the appeal period.

Lodge the appeal before completing every argument

An appeal must comply with procedural requirements. Follow the directions in the notification and promptly check with the relevant registry how the declaration must be lodged. A lawyer can carry out the formal step and develop the grounds, but the immediate priority is not to miss the deadline.

Minimum checklist: full copy of the order, evidence of the notification date, the appellant's identity and legal capacity, current contact details, the provisions challenged and the main outcome sought. Reports, witness material and later developments can then be organised for the hearing.

Develop precise grounds of appeal

Disagreement alone does not show what the court should change. Each ground should be connected to a reason in the order, an item of evidence or an arrangement said to be unsuitable: a factual error, material not discussed, the assessment of risk, proportionality of placement or contact arrangements.

Separate facts that already existed at the first hearing from events that occurred later. The first group supports criticism of the order; the second informs the court about the child's current position. Date every document and add a short explanation of why it matters.

Check the immediate effect of the appeal

Lodging an appeal does not justify assuming that the measure ends immediately. Read what the order says about enforcement and obtain case-specific advice if suspension is being considered. Until a new decision is made, arrangements for the child should not be altered unilaterally.

Report any urgent problem promptly: the care location, health, education, a contact visit that cannot take place or a new danger. The pending appeal does not prevent that problem from being documented and the appropriate provisional application being identified with professional advice.

Prepare for the juvenile chamber hearing

The appeal is heard as a priority and in private by the chamber of the court of appeal responsible for cases involving children. For a provisional placement order under Article 375-5 of the Civil Code, the court must determine the appeal within three months after the appeal declaration.

Before the hearing, update a short chronology, the child's living conditions, contact arrangements, school, healthcare and the outcome sought. Be ready to explain in a few sentences which part of the order should change and which practical arrangement should replace it.

Frequently asked questions

Should an appellant wait for every report before lodging the appeal?

No. For most appellants, time runs from notification of the order. Preserve the appeal within the time limit, then complete the preparation with the material that can be obtained.

Can an event after the original order be relevant on appeal?

Yes. A later event may inform the court about the child's current circumstances and interests. It should be dated, evidenced where possible and kept distinct from criticism of the original order.
